SUBJECT: DUJ COMPLAINT TO THE BAR COUNCIL
We would like to bring to your notice cases of physical assaults on journalists within the premises of the Patiala House Courts as well within a Court Room, on February 15 and 17, 2016.
Attached herewith is the copy of the complaint filed by a member of the Delhi Union of Journalists, Manushankar with the Tilak Marg Police Station on February 15, 2016.
The complaint details the physical assault that he faced on February 15, 2016 at the hands of four members of the Bar at the Patiala House Courts viz. advocate Vikram Singh, advocate P.S.Singh, advocate Shilpesh Choudhary and advocate Yashpal Singh along with a mob of 25 other persons in black robes. Manushankar is a reporter working with the Kairali TV and is based in Delhi.
Due to the severe injuries that Manushankar suffered in the attack, in which iron rods and bamboo sticks were used, he had to be hospitalized at the Rammanohar Lohia Hospital. A copy of the discharge summary of the hospital is also attached herewith.
Several other journalists present in the court were also beaten up and have lodged complaints with the Tilak Marg Police Station.
Apart from brutal physical assaults that many of them, including female journalists, were subjected to, their mobile phones and tablets were also snatched or smashed and filthy abuses hurled at them. They were also called “agents of Pakistani” “anti-nationals” etc.
This incident of journalists, students and teachers being assaulted took place within the Patiala Court Premises on February 15, 2016 when Kanhaiya Kumar, a student of Jawaharlal Nehru University, who has been accused in a sedition case, was to be produced in Court. This incident was widely reported in the media and we are sure this has been brought to your notice also.
The same scene was repeated on February 17, 2016 also when several other journalists were physically attacked and verbally abused. It was the same set of people who led the attack this time also.
It has also been brought to our notice that SMSs were sent to several advocates of the court urging them to prevent the court from functioning and taking up the case relating to Kanhaiya Kumar. One of them states: “Advocates will do justice on the spot no dates no adjournment only action on the spot. Vakil ekta zindabad. We don’t want that type anti-Indians. Humara Hindustan Zindabad Hai aur rehaga. Jai Hind”. There are several other such SMS that have been circulated.
Since these unfortunate assaults have taken place within the premises of the Patiala House Courts and were led by a mob of lawyers dressed in black robes, we are approaching you with a request to institute an enquiry and take appropriate action against those found guilty.
Needless to say that this action by a handful of advocates has brought disrepute to the entire profession.
We hope you will do the needful immediately.
